welcome to memorize earth. these terms of service ("Terms") govern your access to and use of memorizeearth.com (the "Site"), operated by Virtually Funny, Inc. ("we," "us," "our"). by using the Site, you agree to these Terms. if you do not agree, please do not use the Site.
1. description of the service
the Site is a free, browser-based geography quiz and study tool. it is provided for personal, educational, and entertainment use. features may change, be added, or be removed at any time without notice.
2. eligibility
the Site is intended for users aged 13 and over. if you are under 13, please do not use the Site. if you are under the age of majority in your jurisdiction, you should use the Site only with the involvement of a parent or guardian.
3. acceptable use
you agree to use the Site only for lawful purposes and in a way that does not infringe on the rights of others or restrict others' use of the Site. without limitation, you agree not to:
- attempt to gain unauthorized access to any part of the Site, its servers, or related systems;

4. intellectual property
all Site code, design, written content, original imagery, and curated quiz content are owned by Virtually Funny, Inc. and protected by applicable intellectual property laws. you may not copy, redistribute, or build derivative works from the Site's code or content without permission, except as permitted by applicable law (e.g., personal study, fair use).
the Site uses third-party data and assets under their respective licenses, including Natural Earth (public domain), country-flag imagery from public sources, and the d3.js and topojson-client libraries (ISC / BSD-3-Clause). background music tracks are licensed from Epidemic Sound. these remain the property of their respective owners.
5. third-party services and donations
the Site is supported by optional voluntary donations processed by PayPal. Virtually Funny, Inc. is a for-profit company, not a 501(c)(3) charitable organization. donations are not tax-deductible, and Virtually Funny, Inc. does not issue tax receipts. donations are not refundable except where required by law and do not confer any additional rights, account features, or removal of features for the donor. the Site is free and operates the same way for everyone regardless of whether they donate. PayPal handles all payment processing. we never see or store your payment information. the Site may also include links to third-party websites. we are not responsible for the content, accuracy, or practices of those sites. your interactions with third parties are governed by their own terms and policies.
6. no warranty
the Site is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. we do not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components.
quiz answers are presented for educational purposes and may contain errors, omissions, or simplifications. the Site is not a substitute for an authoritative reference work.
7. limitation of liability
to the maximum extent permitted by law, in no event shall Virtually Funny, Inc. or any of its officers, directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising out of or relating to your access to or use of the Site, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if advised of the possibility of such damages.
where applicable law does not permit the exclusion of certain warranties or limitations of liability, the above exclusions and limitations may not apply to you in full, but they will apply to the maximum extent permitted.
8. indemnification
you agree to indemnify and hold Virtually Funny, Inc. and its officers, directors, employees, and affiliates harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of another party.
9. termination
we may suspend or terminate your access to the Site at any time, for any reason, without notice. provisions that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and dispute terms) will survive.
10. changes to these terms
we may update these Terms from time to time. material changes will be reflected by updating the "last updated" date at the top. continued use of the Site after a change constitutes acceptance.
11. governing law
these Terms are governed by the laws of the United States and the State of California, without regard to its conflict-of-laws principles. any disputes shall be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
